An Appeal to Challenge and End a Destructive and Wasteful System

This is a call for us all to be positive. To be positive in striving for justice and support in society for better family relationships.

This is a campaign to raise awareness of very significant shortcomings in the current divorce and financial settlement law. Shortcomings that have been studied, reported and discussed for over 40 years.

This is a drive to raise awareness of malpractices in the Family Court system. Malpractice that thrives due to shortcomings in the wording of the divorce laws. The absence of scrutiny or accountability exacerbates the problem.

This is an initiative to raise awareness that all public officials need to be accountable in the exercise of the power and discretion that we, in a democratic society, lend to them whilst they remain public officials.

This is a call for fairness and balance in the divorce and financial settlement laws and in the associated processes. It is also a campaign for recognition of the fact that not every person or indeed every couple that has the misfortune to get entangled with the divorce process actually wants to get divorced.

The voice of married people who find their marriage in difficulty and threatened by an unwelcome divorce must be heard.

Before we can improve on what we have, it is necessary to know and understand the current problems and challenges being faced. Regrettably, shinning a light into dark corners is sometimes seen as being unhelpful, negative or even as aggressive. None of those adjectives need be applied here.

In academic, scientific, medical and engineering circles it is considered as positive to diagnose problems.

Having thoroughly diagnosed the issues at hand appropriate solutions can be prescribed or new approaches engineered.

It is considered as beneficial to peer review challenging issues and proposed solutions.

Let us us apply the same approach to the challenges of family life.

It is time for us to be positive and bold in displacing the establishment mind-set that once a person approaches a divorce lawyer the marriage cannot be saved and is doomed.

Resources currently being wasted on destructive court and legal processes should be diverted to mediation and reconciliation services for those that wish to save their relationship and family life.

Sadly, the current divorce and financial settlement laws are being miss-interpreted and abused. Consequently, there is more protection for employees under the employment laws, and greater protection for tenants under the tenancy laws than there is for the recipient of a divorce petition who wishes to save his or her marriage. There is little that person can do to retain his or her home or safeguard his or her financial assets.

Please note that financial settlement in this discussion is about Spousal Maintenance and NOT Child Maintenance. The two are separate and distinct.

I could describe my personal experiences. But I believe that to do so would be less compelling than 40 years’ worth of accumulated study and literature. My personal experiences will be detailed in the court hearings.

Accordingly, this exposé of malpractice in family law is told mostly through extracts and quotes taken from government commissioned research documents and independent studies on divorce and financial settlement. Quotes from court cases and judges, legal representative bodies and parliamentary debates are also provided. All of these are in the public domain. All of these support my personal experience of the divorce system. More importantly they establish and speak eloquently of the need for change.

I must point out that it is too late to save my marriage, but there are new marital difficulties arising every day that are being failed by our present system.
